Terms and conditions applicable to the use of the website

Thanks for visiting terms and conditions ( "Terms and Conditions") from Iluminacion que dibuja S.A. de C.V., under the trade name Filamentlux®. Access to and use of the website www.filamentlux.com is subject to the following Terms and Conditions and applicable laws. By accessing and browsing the website Filamentlux®, you agree to these Terms and Conditions without limitation or condition, including the additional terms and conditions that Filamentlux® published or modified from time to time. Certain services and other offerings available on the website of Filamentlux® may have additional terms and conditions to be apply, which can be read on pages containing such services or offers or through a link in these pages or other directions referenced to such terms and conditions. Filamentlux® reserves the right to make changes to the terms and conditions where applicable.

Purchase conditions

You can only buy products: (i) that are available for sale and whose details appear in the online store Filamentlux®; (ii) for delivery to postal codes authorized by the logistics provider, and (iii) intended for personal use, either one's own or third party to buy the products. Also, Filamentlux® reserves the right to reject any order in its sole discretion (for example, when we consider that the order in question will then be sold by others distribution channels than the authorized by Filamentlux®).

Details of the products available for purchase (including price) are specified in the online store Filamentlux®. Filamentlux® take all necessary and reasonable measures to ensure that all details, descriptions and prices of products appearing on the website are correct when information is included. While we will try by all means at our disposal to keep the website of Filamentlux® as updated as possible, the information specified in a given time may not always reflect the exact situation when you place an order, so may come into existence errors regarding available inventory of products, patterns, color or any other product specification.

Once you have selected the desired products, these products will be included in the shopping cart.

At the end of placing the order, you will click on the "My Cart" button to access the summary page of the order in which you can identify and correct any errors in the information.

At the end of the summary page of the order, you must click on the "Continue" button to Filamentlux® have record of your purchase request.

Once you have clicked on the button, we get a permit from the trading company credit card or debit card for the amount indicated on the order summary page. At this point in the process, not withdraw funds from your card, even if the balance on your card will be reduced with the authorization. This process is the usual procedure followed by banks. If your credit card is not authorized, the order will not be processed. You acknowledge and agree to pay Filamentlux® the total amount of the purchase before you receive the products.

Filamentlux® will send you an e-mail confirming that you placed an order, which is not an automatic acceptance by us of your order ("Order Confirmed").

Filamentlux® will be sent a second e-mail confirming that the products you have requested have been sent ("Order Sent").

Filamentlux® may reject, in its sole discretion, order processing, or not be able to proceed with such processing, in the following cases, without limitation: (i) where the product you requested is no longer manufactured or not available; (Ii) when the distributor of your credit card or debit card does not authorize the payment of the purchase price, or (iii) does not meet the criteria for ordering specified at the beginning of this section.

Cancellation policies, return and refund

Once the customer has made the purchase and the bank notifies Filamentlux® payment has been processed, you can not perform cancellation or refund of the purchase.

If the customer requests the return of the product, it only can be done for color changes in products with the same characteristics as long as is in stocks and the returned product does not show has been used. In this case, the customer will need to cover shipping costs.

Delivery Policies

Filamentlux® perform the delivery of your order at the address you indicated and entered on the website of Filamentlux®. Filamentlux® can only perform the delivery of your order in a direction corresponding to a home or office to postal codes available from the logistics provider. Deliveries are made only on weekdays, so they will not be made in weekends or holidays (this connotation of "business day" or "working days" will be used throughout this document when refer to those terms). All deliveries must be accompanied by an acknowledgment of receipt by the logistics provider.

Delivery times will be between two (2) to six (6) days.

Delivery periods are indicative and therefore not considered strict deadlines. The fact of having exceeded a deadline does not give you any right to compensation.

Filamentlux® is not responsible for any duty/taxes and/or brokerage fees that you incur upon receiving your shipment .

When the purchaser enters the postal code of shipping address in the logistics provider tool, he will be informed about shipping costs to be paid. This cost will be displayed separately from the value of the product offered and can be paid only by using the services of the trading company and online payments that has Filamentlux® website.

The purchaser must provide complete and accurate information to ship the product. The purchaser acknowledges that prove to be solely responsible for the consequences resulting from failure from not verify and / or inconsistency of such information.

Delivery Exceptions

According to the contract, the logistics provider has to meet three (3) delivery attempts. For each failed attempt, the logistics provider must leave a delivery notice in the clients home. Following the third unsuccessful attempt, the package will remain under the custody of the logistics provider in the status of "Package with troubles" until you or our the customer service issued an instruction to move the respective packet to any branch logistics provider in the form of "OCCURS" (Store logistics Service provider). The package will remain in status "Package with troubles" for a period of up to 48 (forty eight) hours from arrival.

In case there could be a status change from “Package with troubles” to “OCCURS” (Store Logistics Service Provider), the package will remain there for 48 (forty eight) hours until you go to pick up your product.

The conditions and requirements that you must follow in order pick up your product in “OCCURS” (Store Logistics Service Provider) is performed as follows: (i)show an ID; (ii)provide the tracking number; and (iii)prove the ownership of the package.

Warranty

Iluminacion que dibuja S.A. de C.V., operating under the name Filamentlux® warrants that for a period of three months from the date of purchase, this product will be free from defects in materials and manpower. Filamentlux®, as you choose, will repair or replace this product or any component thereof to be defective during the warranty period. Replacement will be made for new or repaired product or component. If the product is no longer available, it will be replaced by a similar product of equal or greater value. This is your exclusive warranty. Do not attempt to repair or adjust any electrical or mechanical functions on this product, because doing so guarantee can not proceed.

The warranty is valid for the original retail purchaser from the date of initial purchase and is not transferable. Keep the original sales receipt. To obtain warranty is required to present proof of purchase. Agents and Filamentlux® service centers or retail stores that sell Filamentlux® have no right to alter, modify or change in any way the terms and conditions of this warranty.

This warranty does not cover normal wear away or damage that occurs as a result of negligent use or misuse of the product, use on improper voltage or current, use contrary to the operating instructions, disassembly, repair or alteration by a third party or a service center authorized by Filamentlux®. Likewise, the warranty does not cover acts of God such as fire, flood, hurricanes and tornadoes.

What is the limit of liability of Filamentlux®?

Filamentlux® will not be responsible for incidental or consequential damages for breach of any warranty or expressed, implied or statutory condition.

Except to the extent prohibited by applicable law, any implied warranty or condition of merchantability or fitness for a particular purpose it is limited in terms of duration, the term of the above warranty.

Filamentlux® is free of other warranties, conditions or representations, express, implied, statutory or otherwise.

Filamentlux® will not be liable for any damages resulting from the purchase, use or misuse of the product, or the inability to use the product including incidental, special, consequential or similar damages or loss of profits, as well as any breach of contract, it is an essential obligation or otherwise, or for any claim brought against purchaser by a third party.

Some provinces, states or jurisdictions do not allow the exclusion or limitation of incidental or consequential damages or limitations on the duration of implied warranties, so it is possible that the above exclusion or limitations may not apply to you.

This warranty gives you specific legal rights and you may have other rights which vary by state, province or jurisdiction.

These Terms and Conditions are governed by and construed in accordance with the laws of Mexico, without reference to its provisions on conflicts of law. Any and all disputes on the validity or interpretation of these Terms and Conditions or compliance shall be settled exclusively by a competent court in the city of Guadalajara, which will be the only venue for any dispute. If any part of these Terms and Conditions becomes illegal, invalid or unenforceable, that portion shall be severed and shall not affect the validity and enforceability of any remaining provisions. Filamentlux® may modify these Terms and Conditions at any time by updating this posting.

Filamentlux® may terminate this contract early at any time without notice for any reason, without liability and without prior judicial decision.
